SMS Terms & Conditions

These SMS Terms & Conditions (“Terms”) govern your participation in the Capex Inc. text messaging program (“Messaging Service”). By signing up for the Messaging Service, you agree to these Terms, our Privacy Policy, and all applicable laws, including the Telephone Consumer Protection Act (TCPA), CTIA guidelines, and state-specific requirements.
By initiating contact through the SMS-enabled interface, providing your mobile phone number, or otherwise opting in to receive SMS messages from Capex Inc, its clients, or service providers, you consent to receive recurring text messages including updates, promotional offers, and transactional alerts from or on behalf of Capex Inc, Capex.ai, and its business clients at the number you provided.

1. Consent to Receive Messages
By providing your mobile phone number and opting in, you consent to receive recurring automated and/or personalized marketing text messages from Capex Inc. at the number you provided, including cart reminders, promotions, product updates, and other offers.
– Consent is not a condition of purchase.
– Message frequency varies, up to 8 messages per month.
– Messages may be sent using an auto-dialer or other automated system.
– Message and data rates may apply.
2. Prohibited Sending Times (State Laws)
In compliance with applicable state laws, including Florida’s and Oklahoma’s mini-TCPA rules, Capex Inc. will not send marketing text messages before 8:00 a.m. or after 8:00 p.m. local time in your area.
3. Opt-Out Instructions
You may opt out of the Messaging Service at any time by replying with any of the following keywords: STOP, END, CANCEL, UNSUBSCRIBE, QUIT, REVOKE, or OPT OUT.
Upon receipt of your opt-out request:
– You will receive a single confirmation text message.
– No further marketing messages will be sent to your number unless you opt back in.

5. Information We Collect
We collect and store information you provide or that is generated during your participation in the Messaging Service, including:
– Your phone number, email address, and sign-up date/time.
– Message history and any content you include in your messages.
– Device and usage data (e.g., device type, browser, interaction with our website).
– Any additional information provided through surveys, promotions, or support inquiries.
6. Use of Information
We use your information to:
– Deliver and operate the Messaging Service.
– Send you targeted offers, reminders, and updates.
– Improve our services and maintain compliance with laws.
7. Sharing of Information
We may share your information in the following circumstances:
With service providers who assist in delivering the Messaging Service.
As required by law to comply with legal obligations, court orders, or government requests.
In aggregated or de-identified form for research or marketing purposes.
We will never sell your personal information to third parties.
8. Data Retention
We retain your information only as long as necessary to provide the Messaging Service, meet legal requirements, enforce our policies, and resolve disputes.

Messaging via Instagram, WhatsApp & Facebook Messenger (“Messaging Platforms”)

1.Consent to Receive Messages
By opting in via Instagram, WhatsApp, or Facebook Messenger, you consent to receive recurring marketing, service, and transactional messages (“Messages”) from Capex Inc. Messages may include updates, promotional offers, customer support, surveys, and account notifications.
2. Platform-Specific Requirements
Messages may be sent via automated or manual processes. Standard messaging and data rates may apply depending on your service provider.
3. Opt-Out / Unsubscribe
You may opt out at any time by replying with STOP, UNSUBSCRIBE, or another supported keyword within the respective messaging app, or by using the unsubscribe features provided by that platform. Upon receipt of your request, we will stop sending you non-essential messages. Please note that essential service-related communications may still be required to support your account.
4. Consent Is Not a Condition of Purchase
Your consent to receive Messages is voluntary and is not required to make purchases or access services.
5. Age Requirement
You must be at least 13 years old to use the Capex Inc. Messaging Service via SMS, WhatsApp, Instagram, or Facebook Messenger. If you are under 18, you may only participate with the consent of a parent or legal guardian.
Capex Inc. does not knowingly collect personal information from children under 13. If we become aware that we have collected information from a child under 13 without verifiable parental consent, we will delete that information promptly.
By opting in to receive messages, you represent that you meet the minimum age requirement or have obtained the necessary parental/guardian consent.
6. Third-Party Platforms and Compliance
Instagram, WhatsApp, and Facebook Messenger are services provided by Meta Platforms, Inc. Your use of these platforms is also subject to Meta’s terms of use and privacy policies. Capex Inc. is not responsible for changes to these platforms, interruptions in service, or their data handling practices.
7. Privacy and Data Transfer Notice
Your personal information (such as your phone number or Messenger ID) will be used in accordance with our Privacy Policy. Where personal data is transferred outside your country of residence, we will apply appropriate safeguards, including the EU Standard Contractual Clauses (SCCs), the UK Data Bridge, or the International Data Transfer Addendum (IDTA), to protect your information.
